What’s the Difference Between Bail and Bond?

Bail is the amount of money ordered by a magistrate judge for the release of an inmate which will allow the defendant to be released while waiting for his court date(s). Most counties in Florida use uniform bond schedules that provide a predetermined bail amount based on the type of crime the inmate has been accused of. A typical bail amount begins at $2000. If bail is paid directly to the court clerk and the defendant appears for all required court hearings and abides by all bail requirements, the bail (minus court fees) is refundable.

Who is Eligible for Bail?

Not all inmates are eligible for bail to allow pretrial release. And in some cases, the defendant may be eligible for supervised release without monetary bail at all. However, keep in mind that often times, a supervised release (aka: SOR) will end up costing the defendant much more money over time than what he would have paid with a cash bond.

A bail bond is provided by a surety company through a state licensed bondsman. The bail bond agent provides the defendant (who is eligible for release) with the ability to be released from jail for a small portion of the full bail amount set by the court. For a state bond, the cost for a bondsman will be 10% and for a federal bond, 15%. For example, if bail was set at $5000, the bail bonds agent will arrange for the inmate’s release for $500 for a state crime and $750 for federal. Any money paid to the bondsman is non-refundable.
